Datos que tratamos

Tratamos los datos que el usuario facilita a través del formulario de contacto: nombre, correo electrónico, empresa (opcional) y el contenido del mensaje. Junto al mensaje se registran la fecha y hora del envío y la dirección IP desde la que se realiza, como medida de seguridad frente a envíos automatizados.

Con independencia del formulario, la web mide de forma anónima el uso que se hace de ella: páginas visitadas, país, tipo de dispositivo, navegador y web de procedencia. Esta medición no utiliza cookies, no recoge datos identificativos y no permite seguir al visitante entre sitios web distintos.

Finalidad

Atender y responder las consultas y solicitudes remitidas a través del formulario, y en su caso gestionar la relación comercial que se derive de ellas. No se elaboran perfiles ni se toman decisiones automatizadas.

Si el usuario remite una candidatura espontánea de empleo a cualquier dirección de correo del dominio, sus datos se tratarán únicamente para valorar y gestionar esa candidatura.

La medición de uso tiene como única finalidad conocer de forma agregada cómo se utiliza la web y orientar su mejora. No se elaboran perfiles ni se identifica a ningún visitante.

Base jurídica

El consentimiento del usuario al enviar el formulario (art. 6.1.a RGPD). Si la consulta deriva en una relación contractual, el tratamiento se basa además en la ejecución del contrato (art. 6.1.b RGPD) y en el cumplimiento de obligaciones legales del responsable (art. 6.1.c RGPD). En las candidaturas espontáneas, la base es el consentimiento del candidato al remitirlas (art. 6.1.a RGPD).

El registro de la fecha, la hora y la dirección IP del envío se basa en el interés legítimo del responsable en proteger el formulario frente a envíos automatizados y usos abusivos (art. 6.1.f RGPD).

La medición anónima de uso se basa en el interés legítimo del responsable en conocer y mejorar el funcionamiento de su web (art. 6.1.f RGPD). Al no emplear cookies ni almacenamiento en el dispositivo, no resulta de aplicación el artículo 22.2 de la LSSI.

Conservación

Los datos se conservan mientras se gestiona la consulta y, como máximo, hasta un año desde el último contacto con el usuario. Si la consulta deriva en una relación contractual, se conservan durante los plazos exigidos por la normativa fiscal y mercantil. Transcurridos esos plazos se suprimen. Las candidaturas espontáneas se conservan un año desde su recepción, salvo que el candidato solicite antes su supresión. El usuario puede retirar su consentimiento en cualquier momento.

Destinatarios

No se ceden datos a terceros, salvo obligación legal. Los datos son tratados por IONOS Cloud S.L.U., proveedor de alojamiento web y de correo electrónico contratado por el responsable, que actúa como encargado del tratamiento y accede a los datos únicamente para prestar ese servicio, siguiendo las instrucciones del responsable.

Con dicho proveedor se ha suscrito un acuerdo de encargo de tratamiento conforme al artículo 28 del RGPD y al artículo 33 de la LOPDGDD.

La medición de uso la presta Umami Software, Inc. (servicio Umami Cloud), que actúa como encargado del tratamiento y trata únicamente datos anónimos de navegación, sin cookies ni datos identificativos.

Transferencias internacionales

El responsable no comunica datos a destinatarios situados fuera del Espacio Económico Europeo por decisión propia. Conforme al acuerdo suscrito, el tratamiento se realiza en un Estado miembro de la Unión Europea o del Espacio Económico Europeo, salvo que una transferencia a un tercer país resulte necesaria para prestar el servicio; en tal caso quedaría amparada en las garantías previstas en el Capítulo V del RGPD.

El proveedor de la medición de uso es una sociedad estadounidense y opera servidores en la Unión Europea y en Estados Unidos. Si el tratamiento se realizara fuera del Espacio Económico Europeo, quedaría amparado en las garantías previstas en el Capítulo V del RGPD. El usuario puede solicitar información concreta al respecto en sales@sycs.me.

Derechos del usuario

El usuario puede ejercer sus derechos de acceso, rectificación, supresión, oposición, limitación del tratamiento y portabilidad escribiendo a sales@sycs.me, acreditando su identidad. Asimismo, puede presentar una reclamación ante la Agencia Española de Protección de Datos (AEPD, www.aepd.es) si considera que sus derechos no han sido atendidos.

Seguridad

El responsable aplica medidas técnicas y organizativas apropiadas para proteger los datos personales frente a su pérdida, alteración o acceso no autorizado.

Data we process

We process the data provided through the contact form: name, email, company (optional) and the message content. The date and time of the submission and the IP address it was sent from are also recorded, as a security measure against automated submissions.

Separately from the form, the website measures its own usage anonymously: pages viewed, country, device type, browser and referring website. This measurement uses no cookies, collects no identifying data and does not allow visitors to be tracked across different websites.

Purpose

To handle and reply to enquiries sent through the form and, where applicable, to manage any business relationship arising from them. No profiling or automated decision-making is carried out.

If the user sends an unsolicited job application to any email address of the domain, their data will be processed solely to assess and manage that application.

Usage measurement serves solely to understand, in aggregate, how the website is used and to guide its improvement. No profiling is carried out and no visitor is identified.

Legal basis

The user's consent when submitting the form (Art. 6.1.a GDPR). If the enquiry leads to a contractual relationship, processing is additionally based on performance of the contract (Art. 6.1.b GDPR) and on compliance with the controller's legal obligations (Art. 6.1.c GDPR). For unsolicited job applications, the legal basis is the candidate's consent when sending them (Art. 6.1.a GDPR).

Recording the date, time and IP address of the submission is based on the controller's legitimate interest in protecting the form against automated submissions and abusive use (Art. 6.1.f GDPR).

Anonymous usage measurement is based on the controller's legitimate interest in understanding and improving the performance of its website (Art. 6.1.f GDPR). As no cookies or device storage are used, Article 22.2 of Spanish Act 34/2002 (LSSI) does not apply.

Retention

Data is kept while the enquiry is being handled and, at most, for one year from the last contact with the user. If the enquiry leads to a contractual relationship, data is kept for the periods required by tax and commercial law. It is deleted once those periods expire. Unsolicited job applications are kept for one year from receipt, unless the candidate requests earlier erasure. The user may withdraw consent at any time.

Recipients

Data is not shared with third parties except where legally required. Data is processed by IONOS Cloud S.L.U., the web hosting and email provider engaged by the controller, acting as a data processor, which accesses the data solely to deliver that service and on the controller's instructions.

A data processing agreement under Article 28 GDPR and Article 33 of Spanish Organic Law 3/2018 (LOPDGDD) has been entered into with that provider.

Usage measurement is provided by Umami Software, Inc. (Umami Cloud service), acting as a data processor and handling only anonymous browsing data, with no cookies and no identifying data.

International transfers

The controller does not, of its own accord, disclose data to recipients located outside the European Economic Area. Under the agreement in place, processing takes place within a Member State of the European Union or of the European Economic Area, unless a transfer to a third country is necessary to provide the service; in that event the transfer would be covered by the safeguards set out in Chapter V of the GDPR.

The usage-measurement provider is a US company and operates servers in the European Union and in the United States. Should processing take place outside the European Economic Area, it would be covered by the safeguards set out in Chapter V of the GDPR. Users may request specific information at sales@sycs.me.

User rights

The user may exercise the rights of access, rectification, erasure, objection, restriction of processing and portability by writing to sales@sycs.me, proving their identity. The user may also lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).

Security

The controller applies appropriate technical and organisational measures to protect personal data against loss, alteration or unauthorised access.
